- The fee triggers when a deductor or collector files a quarterly TDS / TCS statement (Form 26Q, 24Q, 27Q, or 27EQ) after the prescribed due date — typically the last day of the month following the quarter.
- The fee accrues at ₹200 PER DAY of delay, computed from the day immediately after the due date until the actual filing date.
- The total fee CANNOT exceed the amount of TDS or TCS deductible or collectible in the statement itself.
- Importantly, the fee must be PAID BEFORE the statement is delivered — the e-filing portal will not accept the statement until the §234E fee is paid via challan.
- This provision is distinct from §234F (the LATE ITR FILING fee — a flat ₹5,000 or ₹1,000, not per-day) and from §271H (the penalty for failing to furnish a TDS statement — ₹10,000 to ₹1,00,000).
